1. About these terms

This website is operated by MALU COLLECTIVE (ABN 85 411 442 504), trading as Malu ("we", "us", "our").

By browsing or buying from this site, you agree to these terms. If you don't agree with them, please don't use the site.

We may update these terms from time to time. The version published here at the time you place an order is the one that applies.

2. Who can order

You must be at least 18 years old, or have permission from a parent or guardian, to place an order.

You agree that the information you give us - name, delivery address, contact details, payment details - is accurate and current.

3. Products

We make every effort to show our products accurately. That said, colours can look different from screen to screen, and garments are made from natural fibres, so slight variation between pieces is normal rather than a fault.

Our artworks are hand-drawn, and small differences in print placement are part of how the pieces are made.

Product availability isn't guaranteed. We may limit quantities or discontinue a product at any time.

4. Pricing

All prices are in **Australian dollars (AUD)** and include GST where applicable.

We may change prices at any time without notice. The price that applies to your order is the price shown when you check out.

If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund you in full, even if the order has already been confirmed.

5. Orders

Your order is an offer to buy. We accept it when we send you a confirmation email.

We may refuse or cancel an order - for example, if the item is out of stock, if there's a pricing error, or if we suspect fraud. If we cancel after you've paid, we'll refund you in full.

6. Shipping

We currently ship **within Australia only**.

Delivery timeframes are estimates, not guarantees. Once a parcel is handed to the carrier, delivery is outside our control.

Risk in the goods passes to you on delivery. If a parcel arrives damaged, contact us at admin@maludesigns.com as soon as you can.

Delivery costs are shown at checkout.

7. Returns and refunds

Our Refund Policy forms part of these terms. In short: 14 days from delivery for change-of-mind returns, items unworn with tags attached, and you cover return postage.

Nothing in these terms limits your rights under the Australian Consumer Law.

8. Payment

We accept the payment methods shown at checkout. Payments are processed by third-party providers, and we don't store your full card details.

You confirm that you're authorised to use the payment method you provide.

9. Intellectual property

All artwork, designs, photography, text and branding on this site are owned by us or used with permission. The hand-drawn artworks - including the Flag, Oyster, Donkey Orchid and Life in Waves designs - are original work by Courtney Webb (Gummipingal, Worimi).

You may not reproduce, copy, sell or commercially use any of it without our written permission. Buying a product gives you the product, not the rights to its artwork.

10. Your content

If you send us photos, reviews or comments, you grant us a non-exclusive, royalty-free licence to use them in our marketing.

You confirm that anything you send us is yours to share and doesn't infringe anyone else's rights.

11. Accuracy of the site

We try to keep the site accurate and current, but we don't warrant that it's free of errors or always available. We may change or withdraw content at any time.

12. Liability

To the extent permitted by law, we're not liable for indirect or consequential loss arising from your use of this site or our products.

Nothing in this clause excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where we're permitted to limit our liability, it's limited to replacing the goods or refunding the price paid.

13. Privacy

How we handle your personal information is set out in our Privacy Policy.

14. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
